This is a guide to University of Wisconsin campus and electronic resources for research in
Mexican law. The guide begins with a brief overview of Mexico's geography, history and
political structure, and then proceeds to outline the main sources of Mexican Law. The majority
of the sources in this guide are in Spanish. Annotations are given in English where deemed
necessary.
Please be careful to note the dates of publication for each text, as some may be outdated.
II. Government and Political Structure
Mexico is a democratic republic, consisting of thirty-one states and one federal district. At the
federal level, the government is organized into three branches: executive, legislative and judicial.
The President of the Republic, who is elected by popular vote for a six-year period, heads the
Executive branch. Although both the executive and legislative branch are empowered to initiate
legislation, in practice, the executive branch initiates most legislation.

The legislative branch consists of a bicameral National Congress: the Senate and the Chamber
of Deputies. The Congress discusses and approves legislation and ratifies presidential
appointments.
The state governments are also divided into three branches: executive, legislative and judicial.
The Governor, who holds executive power for a six year term, applies state laws. Governors may
not be reelected. The legislative branch only has one chamber, the chamber of representatives.
Mexico has a federal and state court system. The Mexican Federal Judiciary is organized
according to a three-tier system. At the apex is the Supreme Court (Suprema Corte de Justicia
de la Nacion) which has final appellate jurisdiction over all state and federal courts. Three levels
of circuit courts operate as the fedaral appellate courts. The individual district courts serve as the
trial courts.
The states organize their courts along federal lines, although some of the smaller states do not
have the intermediate appellate court.
III. Sources of Mexican Law
Federal law is dominant in Mexico, and overrides state law in cases of conflict. The hierarchy in
terms of sources of federal law is: Constitution, Legislation, Regulation, and Custom. The
constitution overrides legislation; legislation overrides regulation; and regulation overrides all
custom. The persuasive value of case law in Mexico is limited in comparison to the importance
of precedent in U.S. jurisprudence, but Mexican courts do create binding case law in certain
circumstances. This binding precedent is called jurisprudencia.

In general, the three most common and important steps in Mexican Legal research are: finding
the relevant article or articles in the appropriate code, finding doctrine (doctrina), and finding
the relevant binding case law, or jurisprudencia. The most critical and necessary step is
researching the relevant code.

Mexico's legal system is based on the civil law tradition. As in most civil law countries, the
starting point for Mexican legal research is legislation, and at the federal level, the federal
codes.

C. Doctrine (Doctrina)
Legal scholars of the civil law tradition produce legal treatises that are referred to as doctrine
(doctrina). In the civil law tradition, legal researchers accord doctrine a status similar to the
status of case law in the common law tradition.
The materials listed below in the Treatises and Journals sections would be considered by the
common law researcher as secondary resources. Some of these materials are introductory and
would not fit under the category of doctrine as it is understood in the civil law tradition.

D. Case Law
In theory, the principle of stare decisis is not recognized in Mexican jurisprudence. There are
exceptions, however. A ruling will become binding when a court renders a decision by a
specified number of votes and on the same point of law in five successive decisions. This
Jurisprudencia (precedent) is binding on the court that established it and on all lower federal
and state courts.
